Same reason why the vast majority of the OKW were sentenced to death for Crimes Against Peace with the surprise nature of Barbarossa. Just because a surprise attack is the oldest trick in the book, doesn’t make it not illegal.
Also Pearl Harbour was not expected. The core reason behind it being a war crime was that the US and Japan were in peace negotiations to put an end to the Second Sino-Japanese War, and Japan’s recent annexation of Vietnam. Japan entered the negotiation with no intention of them going anywhere, and broke off the talks 30 minutes before the attack, thereby committing perfidy.
So the summary of the war propaganda is that any actions by Pax Americana have good net benefits, good intentions, and support by celebrities while the enemy, dissenters, and anyone who questioned the indoctrination have bad intentions, evil nature, bad karma, and dangers that must be prevented at all cost. This sound like the action adventure fiction genre with foreign savourism and where a group of outsiders depend on the authoritarian rule by an ignorant self-centered normal white person from the European diaspora. It is also like those traditional isekai hero genre in Japanese fiction that praised foreign savourism and now include new fiction stories that insult the foreign savour mentality. It is also like the white men burden propaganda where European immigrants forced their burden on the nativist people of color or the doctrine that everyone will eventually evolved into European culturally and biologically that justify genocide, free riding, and oppression.
