They obviously should fight it - I don't know if their battle plan included highlighting the problems with electoralism in a bourgoisie democracy (which I wouldn't put it past them) but they should have already strategised for these kinds of attempts - clearly the powers that be would use legalism against them if they were a perceived sufficient threat (which they appear to be... good on them!).

The US and democracy have nothing in common.
