Pretty sure Roberts is against and it is 5-4 but I would not be mad to see two justices die over this by accident (in minecraft). Imagine it happening and this still goes through though, expect the scales to be lifted from many a lib's eyes.

Politicians knowingly violating the constitution are just seeing how far they can bend the powers of government to their will. Shibboleth's to the constitution are performative, the document is not. At times the document enshrined racialized slavery, alcohol prohibition, and other ills. As written, punitive slavery is still legal and good. The law can grant further rights that don't exist in the constitution but it cannot violate the document. It is not the concept of the constitution that drives America, America is the constitution and very little else.

Supreme Court Justices must actively be serving at the time an opinion is made public in order for their votes to count. This means that a Justice who has already heard oral arguments, made a decision on the matter, or even wrote the majority opinion cannot cast a vote in the final decision if he or she dies or leaves the bench before it is announced.
