The dems want to have their cake and eat it too.

In February, 2021 Biden was telling Americans the world "America is Back!" He actually seemed to believe his own bullshit. Tens of millions of Americans hated him, they didn't think he was actually president, and Trump plus the GOP were toxic and a continuing clear and present danger to the country.

I think it's undeniable that Biden choose Merrick Garland for the optics of Biden's "America is back (to normal)" push. Biden must have hoped that Garland wouldn't do anything to Trump about January 6th or anything else. Garland would write some reports and that would be that. For ~2 years it seemed Garland wasn't going to do a thing about January 6th and Trump's crystal clear law breaking of his hording of the most super-top secret documents the US has. I think Garland started to worry about his own legacy - because the worst, shittiest people always worry how they will appear in history. So he appointed Jack Smith even though it was already too late.

Eventually- of course - the dems started to yell, scream, whine, and rend their garments that Trump is fascism itself. That was true two fucking weeks before Biden was even officially president. All Biden needed to do was appoint an aggressive AG and by now Trump would have probably been found guilty in those two cases. But in our actual reality - the chance of either case coming to trial before the election is zero. And if Trump wins - both cases are instantly dead.
