The definition of the crime against humanity of apartheid is, under the International Convention on the Suppression and Punishment of the Crime of Apartheid and the Rome Statute of the International Criminal Court, consists of the following three elements:
- An intent to maintain the domination by one group over another.
- A context of systematic oppression by one group over another.
- An inhumane act or acts.
It is also important to note that this applies to individual actions -- the crime of apartheid is an individual crime, the concept of an "apartheid state" isn't legally recognized.
If social classes are valid groups for the definition, and we assume that the bourgeoisie is class conscious, and acts in their class interests, this meets the first element. The second element is also readily apparent. I am certain that we can also find several inhumane acts committed in the name of maintaining domination of the bourgeoisie over the proletariat. Because of the intent of domination, and the wider context of systematic oppression of the proletariat, those acts are crimes against humanity per international law.
