Has there ever been precedent for the SC barring a judge from ruling on a decision? Like, any past accounts of a ruling from them being done by 8 or less instead of 9?
Right, I was thinking more along the lines of "have the rest of the judges ever told one to sit this one out" in the past rather than a judge recusing themselves.
