SCOTUS doesn't have a heavy bias towards "non-interference", that's just the cynical pretext the Republican majority often hides behind. The moment that states deviate to the left, they are more than happy to rediscover federalism and the equal protection clause (plus absurd interpretations of it).

But both directions assist in balkanization, so the point stands anyways.
