The egregious decision leaves little recourse for those who endure discrimination on the basis of race, sex, and disability.

While using lawsuits as a deterrent against discrimination is obviously a bad system, this is nonetheless one of the only ways victims have been able to get any retribution. This also significantly weakens the power of the Civil Rights Act and Title IX by removing the primary mechanism for civil suits using their protections. It's not like the supreme court's gonna punish companies for discrimination. Yeehaw, everybody. Land of the free.
