Don't just not talk to the cops, you have to explicitly invoke your right to remain silent otherwise, if you haven't had your rights read, they can still use your silence against you.
"I wish to observe my 5th amendment right to remain silent" or something like that.

If your bro don't have a lot of dough saved up he can look into his city/state bar association for a list of probono / cheap lawyers representation. Gotta make sure they aren't the kind of lawyer that'll look at this case and say "might as well plea deal", so try to talk to more than one lawyer to see what options he got
He should just let it go to court. They're not gonna hold him in jail until the court date or anything, probably just has to pinky swear to not leave the city, he'll get a public defender who will do just fine, I'm confident that pretty much any judge would dismiss this kind of thing real fast. He might need to pay for the thermos.
This is a gamble. I did this and got completely fucked. They trade you around and may use you as a bargaining tool to get someone else off.
People can occasionally make their case for that, but that's usually people with a room who have been there for a while and even then it's a pretty slim chance you'll won over the leaseholder.
