I think it's a matter of degrees.
My brother-in-law is a shameless MAGA loser. But he's got a wife and kids who are genuinely good. He's the family's primary breadwinner. His politics suck, but sending him to jail would ruin the lives of his entire family. It would devastate my wife and father-in-law. And the kind of treatment he receives would be monstrous compared to the simple grudge I hold against him for having bad politics.
If he was the kind of person who deserved to go to jail, yeah, sure. Go for it. But if he's just some loud-mouthed asshole, sticking him in a concrete hole for years... that's not praxis. That's nightmarish.
