The "punishment fitting the crime" in Chelsea's case would be them going into her computer and publishing embarrassing fan fics she's written or something. Not extrajudicial torture...
There have been countless individuals that have been picked up by the CIA or CIA related entities, dropped off to one of their many black sites across the world, held and tortured for years, and then dropped off into the middle of a random African country one day. You might hear about them here and there, but there are many others that pick whatever is left of their sanity up and go back to their lives, grateful that they're still alive.
The example of Guantanamo makes his point even worse. Despite whatever rudimentary access might have been allowed, those inmates still haven't seen any justice to this day. Americans suck
It's absolutely a bias in that the detainees who are innocent and have been visited by counsel at Guantanamo are the ones we know about
