Yeah this was written in 2004, a year after Lawrence v. Texas. Fourteen states still had sodomy laws all the way up until 2003.
It actually wasn't illegal to discriminate against gay or trans employees until 2020, with Bostock v. Clayton County. It's still legal in several states to deny housing on the basis of orientation or gender identity.

I've also been refused service at a Denny's, but in my case it was due to being highly inebriated and vomiting in the potted plants at 3am
