    That’s already the law lol. Immigrants are asked if they were part of a communist party (never asked if they were part of a fascist party), and it’s technically illegal for Americans to be part of a communist party (not illegal to be part of a fascist party) but it’s currently unenforced.

          No, but lawyers and judges sniff their own farts a lot and most of them are totally delusional about what the legal system actually is, so they can get pretty riled up about this stuff.
