But the fun part of that is that the latter is extremely vague, so any fascist can argue “actually, we just ask questions, we’re not extremist” and the court will say “ah makes sense.”

    That’s already the law lol. Immigrants are asked if they were part of a communist party (never asked if they were part of a fascist party), and it’s technically illegal for Americans to be part of a communist party (not illegal to be part of a fascist party) but it’s currently unenforced.
