    you have the "right" to a jury trial (most of the time) but if they don't return the correct verdict we'll just change it

      I mean, yeah that's how appellate courts are supposed to work. That's how Roe v Wade and Brown v Board and Oberfell v Hodges worked.

      ACAB and all. Fuck this guy in particular. But this isn't out of line with how courts are ideally going to operate.

        it doesn't seem like this was an appeal, the jury returned a verdict and the judge flipped it. did I misread it?

          The judge overruled the jury on the ground that the prosecution failed to establish a violation of the law. Which is what judges are ultimately there to do. Juries aren't intended to understand the law, only to understand the facts and decide based on their perceived veracity.

          Again, this was a shit ruling by a shit judge and upheld by a shit appellate court. But the problem was the circumstance not the system. Judges can and do periodically overturn jury verdicts.

          At some level, there's a distinction between the system and the people participating in it.

      It's a pretty big subcategory of vore kink that overlaps into pulpy horror/peril stuff, pretty much just the classic "fear + sexy = double sexy" effect that horror movies have been using for the past century.

      Men being predatory creeps is an unrelated thing, as evidenced by all the vanilla cops who are violent domestic abusers or sexual predators and all the NSA scumbags using PRISM to stalk single women or their exes. The takeaway should be that we live in a patriarchal society where predatory men feel like they can push their desires on women, especially when they get an ounce of power over them, and that predatory behavior is an endemic problem unrelated to even weird kinks, and that even using kink as a cover for predatory behavior is less common than abusive creeps finding victims normally.

    Did the judge overturn the conspiracy charge, but not the improper use of a government database charge? Based on this summarry it sounds like he got it right, kink chatrooms are not a conspiracy to commit a crime but digging up people's info in a police database is fucked for any reason. The real fuckup here is the second circuit deciding that cops can pull information from a police database for personal reasons.

      Dated a cop's daughter in my younger years. When I first met him, he asked my name, as I said it, gf interrupted to stop me cuz he database checks everyone who tells him their name. The story has a happy ending though, we broke up and her dad died :officer-down:

      Making about it specific people you know and going so far as to look them up in the database makes it completely different to just having a kink that isn't exactly mainstream.
