What do you mean "cant start"? A union is just a group of people lol. Like literally talk to people, agree to act in certain ways in unison and you have a union.

They have very specific rules about what you are allowed to strike for, how you are allowed to strike, and who is allowed to strike. Unions are also legally required to spy on themselves and report to the bosses.

Your union has to be set up under the NLRA or else strikes are considered wildcat strikes, which are illegal in the US. In Canada, you may only strike for economic reasons as part of a labor dispute - no solidarity or wildcat strikes are legal.
You can still set up a union not under NLRA and unions were formed in the US well before unionizing came under civil rights protections, but its harder to do stuff and retaliation from bosses can be (legally) harsher. The West Virginia Teachers strike the other year was wildcat yet I don't think anyone faced any retaliation, it's not like it doesn't happen.
