Been reading "Second Founding" by Eric Foner and I gotta say, the Supreme Court has always been the most consistently reactionary wing of the US government, which is in and of it self a supremely reactionary government by nature. I just got done reading about how the supreme court let some guys get away with axe-murdering a black family after a lower court found them guilty.

    Quote:

The first involved the scope of federal authority under the Civil Rights Act of 1866. Blyew v. United States, decided in 1872, arose from the gruesome ax murder of four members of a black family in Kentucky by two white men. Benjamin H. Bristow, the United States attorney in the state, removed the case from state to federal court because Kentucky still did not allow blacks to testify in cases involving whites. The murderers were convicted and sentenced to be executed. By a six–two vote, with Chief Justice Chase not participating, the Supreme Court overturned the convictions.

I feel like they'll go after labor laws next with the increased unionization going on. Maybe bringing back child labor as well using some "age of consent" argument? :brace-watching:

Honestly I think they're done with the rights chopping for a while after abortion, which still has plenty of weight to carry political discussions through the midterms. Most of the work that needs to happen is still being brewed up in the trial courts and regulatory agencies. The supreme court hasn't experienced consequences but they are definitely hated right now at historically high levels. They probably feel their power waning.

I expect the supreme court will focus more, like some regulators including the IRS recently, onto the growing number of "small business owners" that are wholesale just ripping off the system. I've heard countless stories of these companies just being funnelled money or avoiding their taxes through loopholes that aren't being enforced.

That was fine when there was enough money to go around. But now things are retracting a bit, I expect that the fun will dry up and it will be the IRS and Supreme Court making sure that happens.

In the election ads in my area the Republican candidate keeps going off about how the democrats want to hire an “army of IRS agents” to destroy the middle class. The ads literally show little billy in the store not able to get the candy he wants because the IRS is auditing his mom I guess.

TV ads make a lot more sense when you think about how they're targeted at people whose first experience of the automobile was the Model T

Ha. They're not wrong that's exactly what's happening with the IRS. They just hired a fuck ton of auditors.

They're just wrong that it's the "democrats" doing it. Just like the democrats think it's just the republicans gathering up kids into cages. But easy enough to campaign off of.

        :deeper-sadness:

Is it not something that was initiated by the Dems?

It's not like they personally give a shit or care if rights are taken away. They're just trying to party.

Public opinion matters it's why they spend so much money trying to sway it. It's enough of a consequence to slow this kind of momentum because the opposite is also true: there's also no consequence if they don't take away more LGBTQ rights.

The supreme court justices want to feel happier at their wine receptions or ski outings. It's harder to do that if tons of folks hate you.

They're not done, but I think they'll do their best to time it until after the elections

There's some Idaho ranchers or something who have a case about what extent of wetlands can be protected by the Clean Water Act. Obama's admin defined it as a much larger area and applied it to seasonal wetlands and the Trump admin scaled it back significantly and said it was basically only areas that were actually wetlands year-round and that the protections didn't extend to the catchment area.

So I expect further limiting of the Feds' power to make sure that water is potable and all the animals don't die.

They are going to re-intensify native genocide by repealing the ICWA, saying that assimilation of indigenous is good actually, or at the very least it's reverse racism to prevent it. :agony:

Edit: skimming through this article they will also axe affirmative action, codify the right for business owners to hate gays, codify the right for state legislatures to gerrymander, and maybe let state legislatures decide on how their state votes in presidential elections.

They actually just upheld bans on bump stocks again. I wouldn't be surprised to see the 2nd amendment start to be scaled back, not that any of the pea shooters most folks can actually own could do much against militarized police forces or the actual military, but it's bad for business if the proles are having gun battles in the streets over drag shows.

ctrl f strike, none; today the supreme court decided to hear arguments that will result in them making strikes effectively illegal.
