The filibuster is not a law, it's a rule that gets reinstated every term (2 years) with the rest of the rule packages. Rules changes cannot be filibustered.

Also something I've been wondering, couldn't someone just filibuster removing the filibuster?
I'm serious when I say that even if the dems get five more senate seats - they won't kill the filibuster.
They turned it into something like a sacred, holy relic. They want it to exist forever.
